Jim Fleming is an unlucky guy. Apparently his sedan got broken into last week (or sometime last March) and a truckload of cardboard was stolen (in addition to his laptop and other sundry items).

We feel bad for Jim (James? Mr. Fleming? Jim Flartner?). We haven't seen any police report, but it appears that his insurance company isn't covering the loss of his growing board game collection (or maybe they are covering it, but he'd really like to spend that insurance money on buying a new house, growing his family, and possibly getting a dog).

We understand, Jim. As indie board game publishers, we are awash with cash and have loads of extra games that we'd like to unload on people in unfortunate circumstances. We also feel it is our responsibility to replace your lost games because, hey, if we didn't make them so darn attractive to thieves, your car would not have been broken into (kudos to the thief's good taste, though)!

We also know Jim has a lot of other life stuff going on (did I mention the new house, dog, and baby?), and he would prefer not to pay shipping for any of these free games. Fortunately for Jim, our board game community is filled with really nice guys who would be happy to pay out of pocket for your own misfortune. So shipping is free, Jim! We'll get those games to you just as soon as we can.

Jim bought my game on BGG (nevermind that, at the time of this geeklist, no sales for my game were made on BGG). He also bought some other games on Amazon (that were not listed there and are currently out of print) and he got some exclusive games that would have been virtually impossible for him to get within the timeline he has detailed. So clearly Jim has put a lot of effort into getting these games by unconventional means. In fact, I bet he has received a lot of games through his unconventional tactics. He's a smart guy who knows a good con deal when he sees one.

Anyway, us publishers were chatting, and we thought it would be worthwhile to put together a Geeklist of all the games stolen by from Jim. After all, we would hate to leave out any games that need to be replaced. So if you suspect your game was stolen from Jim's car sometime last week or last March, please add your game here along with any interactions you have had with Jim. He sounds like a really nice guy, and we want to make sure he gets everything he deserves.

Jim Fleming wrote:

Among them was my copy of Imperial Harvest. =(

I know there is likely no precedent for this, and that you being able to help me out is not likely, but I figured I would ask - is there any way Broomstick Monkey Games would be able to replace my copy?

Again, I know this is asking a lot, but I thought I would reach out and check.

Thanks so much!
Jim
EDIT: Fake games (ones that Jim did not actually try to scam people with/for have been removed from the list. Many of the jokes were funny, but I felt it was more important that we be clear about exactly which games Jim tried to steal (or sell to others duplicitously).

A rep from Eagle Games just told me they also got the email on March 31st stating he lost 3 games and all the expansions. Man - I think we're reaching the point where it wouldn't be physically possible to have the games he claimed stolen to be jammed into his car.

(my initial comment read)

I totally trusted Jim when he told me his story.

(and then later I wrote this...)

UPDATE:

I have been having a conversation with Jim today (ever since I posted this item in the list).

He has admited wrong-doing to me and apparently feels great remorse about what he has done.

In the conversation we have been having I have suggested several things he might consider doing to build back his reputation in the community (if that's possible) and to feel better about himself (which I think is more important).

You can (if you wish) see all of this below in a totally unedited email chain.*

* when I say "totally unedited", I should point out that I did remove my email signature from every instance it occurred just to shorten the long wall-of-text below a bit.

Note #1: I do not know Jim.

Note #2: I am not defending Jim.

Note #3: I assume that posting this will in some way help everyone involved (or at least some of the people).

Note #4: As you can see below, I did this with Jim's permission.

Note #5: Since I think this is in some way helpful, I will post a link to it in the comments section.

Sincerely,

Karl, Founder CMG

Thanks again,

I do agree that part of the price you pay for this should be to take the whole loss and not try to spread it to others.

Another thing you could do is make a list of all the publishers you approached and slowly over time try to repay them.

Examples of what you could do it...

Back their kickstarter to get the new game at full Kickstarter pricing (no deals), and even go as far as to...

Volunteer time helping them at cons, and to possibly start a game club at a local community center that serves under privileged youth, etc.

These are just ideas.

Doing these things could help rebuild your reputation and make you feel better about yourself.

Good luck!

Karl

PS - have you tried (yet) to tell the community what you just told me via that list or by other means?

Karl,

To start - I have no excuse. I have acted despicably.

I was the victim of a crime. But not earlier this week, last month, in March.

I did have a copy of Police Precinct in the car, and a large number of other games (I was in the middle of a move at the time, and was moving a carload of games at the time of the incident - 1 blue IKEA bag in the front seat, 3 in the back, and 3 in the trunk - but not a copy of every game I claimed I had.

I was the victim of a crime, but I did lie about when it happened. I thought if I told people it happened more recently than it did, I might be able to garner more sympathy, and thus, more free stuff. That is despicable, disgusting, and not at all like the person I picture myself being.

I let myself fall into a self-pity-pit and me emailing good people like yourself asking for handouts was nothing more than me allowing myself to wallow. "My car was broken into and I lost some replaceable goods - 'Oh, woe is me!'"

We did have renter's insurance, but it turns out the policy my wife got for us didn't include me. So when we filed the claim, it was rejected because the property we were claiming was stolen was mine.

Either way, I am truly sorry for trying to take advantage of your good nature. I know it is so easy for me to say now, in retrospect, and such a cliche, but I'm glad I was caught. That isn't who I want to be, and not how I want to act. I know I'm not a bad person, but I acted like a grade-A asshole. The only glimmer of good here is that going through this, and feeling as low and as much sincere self-loathing as I do now, I know I'll never act in this way again.

I know nothing I can say will change the way you (or I) feel about myself right now. But there it is.

Attached is a police report an officer brought to me after some of my stolen goods were found in another district of the city. They contacted me because among the items turned in was my ID.

Sincerely,
Jim

I am posting on the list in a totally neutral way because I think it's my duty.

Both my duty to post AND to do it in a neutral way.

All I said was...

A. KICKSTARTER:
During the Upcoming Kickstarter pledge at the $25 level and get a demo copy for $15 with free shipping along with some extras that put you at or above $25. (just remind me after the KS is over about the $15 demo copy offer)

-- OR --

B. AFTER KICKSTARTER:
If nothing appeals to you enough to do option A (or finances are too tight), pick back up this conversation after the KS ends by replying again to this email, and I'll ship you the Demo for a Paypal of $15 (free shipping).

Sound good?

How about if we (you and I) share in the loss?

Meaning, we would pay part of the cost (so to speak -- via a ridiculously large discount) and you would pay part of the cost.

Plan A:
I sell you a game at 60% off MSRP with Free shipping in conjunction with our upcoming Kickstarter. That would be a brand new game in shrink for $24 (that's less than what stores pay).

Plan B:
The other option is to send you a Dent and ding game for even less (like a beat up demo copy).

Thoughts?

=================== Added a Day Later (below) ====================

Reflections From "The Morning After"...

I feel like Jim used me as a tool in this. He could see that I was slow to think the worst of him so he played me.

That said...

I really DO hope that he takes my advice and gives back to the world in some way. I know this is HIGHLY unlikely, but I can still hope.

Here's how this situation has all unfolded in my little world...

Over this past weekend Jim approached me and we worked out a plan for how we (Common Man) could help him with his unfortunate situation.

Then I saw a tweet yesterday from Minion about this and came here to look at this list so that I could see what it was all about. I very quickly realized that this guy (Jim) might be scamming a lot of people, so I (rather than reading the entire thread) quickly posted my item. As soon as I was done doing that, I then told Jim that I had seen this list and even posted my item to it. I wanted to hear his thoughts on this matter. I also wanted to him to know that this wasn't a matter of me "talking behind his back". In essence, I wanted to "look him in the eye" and ask him about this directly.

That's how the conversation started, and please know that during the conversation, I was both working and going back and forth with him (not reading the thread any deeper), so all I really knew is that a good number of people were apparently quite concerned that he might be scamming the system so-to-speak (I had no idea of the real depth of it).

During the talk we had (via email) he admitted that he was doing very bad things in this case and said he deeply regretted his actions. I offered to let him tell the world of gamers what he had already told me via my posting our entire chat (since he had already by that point been banned from BGG and was unable to do this himself). He agreed, and I did so.

I have no regrets about that, but I want to say that it was AFTER that point in time that I started reading more of the thread and realizing that this guy had been doing this at a criminal level for years.

This made me feel like I had been used and played by a master con artist.

I felt sad, angry, and much more -- but due to the way this community is to its core I did NOT feel alone.

I wish to sayTHANKS to all of you for your great outrage and clear stand on this kind of behavior. This industry/hobby is a very unique one, and one that I'm quite proud to be a part of.

thumbsupthumbsupthumbsupthumbsupthumbsup

Part of the Healing Process for me...

Involves creating this:

From gallery of Common Man Games

Not fully sure why, but seeing this somehow makes me happy!

PS - I just updated the card to reflect The REAL Officer who reported the incident! (Officer J.T. Call -- The O.P.) J.T. we all thank you, GREAT Job!!!

Final Thoughts:
(written in the days following)
At times I feel like I don't ever want Jim to come back to our community, but when I reflect deeper I have to say that I truly hope that this story is not over and that in the end, after a long hard road to recovery (meant in every sense) Jim becomes a person that we all know, love, and trust. For me, this could not happen overnight. I would have to see many years of dedication on his part. No matter what, I hope for the best for Jim.

We received the same email and were about to send replacement games to him today. Fortunately, I did my daily morning check of BGG subscriptions and came across this list.

As I tweeted earlier, game publishers have big hearts and small profits. Taking advantage of them by lying for free product is a disgrace of this great community.

Hopefully this proves how tight knit of a group we all are, and discourages others from similar devious behavior.

Hi, James! I'm so sorry to hear that!

I don't have any chips of Tower remaining, but I'll gladly send you a copy of PD and a game mat--just send me your address.

Feeling bad for him, and thinking that most folks are indeed good natured and not lying scumbags, we sent him a copy of both games.

Way to go, James...by doing this to everyone you've pretty much wrecked it for the other lying scumbags who will now have to think of a better story than that one.

Jim was also a participant in the Pay it Forward First (PIFF) — Spreading Board Game Geek Love chain.

At this point, I do not believe anyone was stiffed by him there, but it is uncertain whether any PIFF has been carried out using scammed/stolen games.

As I find out more, if it turns out anyone has been scammed by him there, I'll work to take care of anyone affected by his actions.

Do not trust anything he says in his "apology" email. He tried to scam me way back in 2012. This is not new behavior for Jim.

I was supposed to receive a trade from him in a math trade. I didn't receive it for months.

He then claimed his mother had died (yes, literally claimed a family member passed), and that his Dad was battling depression due to the incident.

I initially believed him and almost offered for him to just keep the game until a post from a different user said that Jim was lying to him and wouldn't refund a purchase.

I then did some internet sleuthing and his Mom had not passed, in fact, she had recently thrown him a party based on his twitter feed.

I immediately contacted Octavian who made Jim give me my game.

He is a crook, no more and no less.

Edit: I am not BGG savvy but I can copy and paste the gms here if people desire.

Edit2: Here is the gm conversation.

Subject: Re:A la Carte
Jim,

I completely understand and am sympathetic towards your position.

With that said, it is time to ship the game. It not only has been four months but much more importantly, you have done numerous trades along with various purchases and sales in the marketplace since my game was supposed to have shipped. So, I hope you can understand why I won't contact Octavian until I have my game.

I am sorry it had to happen like this but I am growing increasingly concerned about this trade. I read a forum that discussed a situation very similar to the one we are having and it turned out someone purchased a game from you in the marketplace and they have yet to receive it as well. This is very concerning and I would like my game as soon as possible so I can give octavian the all clear.

If you are unable to send the game in a quick manner a 33.00 gift card from coolstuffinc will suffice as that is what the game costs and I will even have to pay for shipping.

Sincerely,

George

jobin13 wrote:
I am so sorry. I hate when planned gifts don't work out. I hate that I was the reason for that.

I still don't have a solid timeline for my return home. I might not even have a job to come home to. But that's neither here nor there.

I would say that unfortunately, I don't think I'll be able to get it out in time.

Also, Octavian contacted me about your complaint to him. As long as your still understanding of my situation, would you mind messaging him?

Jim

Normscoffee wrote:
I am terribly sorry to hear about this additional loss.

Do you have any idea when you will be able to ship out the game? It has been four months since the trade was supposed to occur. If it was just for me, I wouldn't mind waiting but it was supposed to be my fiancee's Christmas gift, then her birthday gift and now I am running up against the deadline to make it an anniversary gift. Is it at all possible to send out the game or have one of your neighbors do it within the next couple of days? I need to know so I can figure out whether to come up with backup plan for a gift.

Thanks so much and please know how sorry I am to hear that you are having such a rough time. I know too well what it can be like to lose someone so close to you.

Sincerely,

George

jobin13 wrote:
I apologize for my lack of communication.

My father had a history of depression. After my mother's passing, he struggled for a while, but ultimately succumbed.

After losing him as well, life has been....I don't even know.

I'm still at my parents, but will ship as soon as I can.

I may need to hold an auction to raise money for my missed time at work and to ship some games I need to ship.

I will try to do better to keep you in the loop.

Jim

Normscoffee wrote:
Jim,

I still have not heard from you. I am becoming concerned about this trade. If you no longer have the game or if you need to work something else out, please let me know. I have never been burned in a math trade and hope that is not happening here.

As I said earlier, I have left positive feedback for someone even though they were six months late in shipping the game. The only concerning thing is the lack of contact. Please let me know what is going on and we can work something out.

Sincerely,

George

jobin13 wrote:
Sorry!

I was pretty sure I had gotten in touch with all of my pending trades...if not - I am at my parents' place. My mom passed away recently and I've been here ever since.

My dad has a history with depression and is really struggling.

I will ship ASAP - I'm really sorry.

Jim

Normscoffee wrote:
Hello,

I am becoming somewhat concerned by the lack of contact over this trade. Can you please let me know if/when you plan on shipping out the game. I am very understanding and had someone not ship a game for more than 7 months and I still gave them positive feedback but I need to know what is going on.

If there is a problem, please feel free to gm me and I am sure we can work something out.

Hope you are having a good day.

Sincerely,

George

**** What is not included in this conversation is the fact he tried to scam someone else in the same math trade and told him his Dad was still alive, but depressed. So, Jim lied to me about both parents dying and lied to someone else about one parent dying.

We sent him a copy of Entropy and forwarded the email to our co-publisher about getting a replacement sent for Rise to Power also.

Looking at the list of games he's asked, I just don't see any remorse in him after being outed. No one that is troubled by their own moral values will orchestrate such a scam of this scale. He either automated the emails by scraping the BGG publisher list or he manually wrote each email to the publishers. Either way, this requires time and effort and it's not something a person does if they're concerned at all by the consequences.

He also asked for a copy of Rise to Power. As we no longer have any stock of the game and asked our co-publisher to look into it. Kevin from Ape Games pointed us to this post much to our dismay.

Oh dear, so sorry to hear this. He took advantage of Mercury Games too. You know, despite being a tiny company who can ill-afford to lose product, sometimes you just want to help people make the best of a bad situation.

Here is the first of several emails we exchanged with him (this may sound familiar):

Last week, my car was broken into (http://goo.gl/b3Gkjx). In addition to taking my backpack, which contained my wallet, social security card, and $2000 laptop, they also took a bunch of games I had in the backseat.

Among them were Walled City and The Capitals. =(

I know there is no precedent for this, and that you being able to help me out is not likely, but I figured I would ask - is there any way Mercury Games would be able to replace any of the games I lost?

Again, I know this is asking a lot, but I thought I would reach out and check.

Thanks so much!
Jim

It's worth noting that this took place back on March 31st, so it appears as though we were one of the first hit?

I think he might have been trolling Kickstarter for the games, because this happened to us right after we launched ours. Certainly a good way to find small publishers who might feel vulnerable or eager for publicity.

We were just about to send him a game, so thanks to the community for being vigilant!

... and as a "hope you feel better soon" gesture, we also surprised him with this for free.

For what it's worth, upon further research, I see we've also previously had correspondence from this fellow back in 2014:

My name is Jim Flemming. I am reaching out to you today because I am very interested in possibly being sent a review copy of The Capitals in order to write something up and post to the blog I am going to be taking over - boardgamereviewsbyjosh.com.

I am very interested in the combination of city building, AP allowance, and tile placement. I have a couple reviews up on Josh's site already, as well as a few on BGG and on gameswithtwo.com. I can send links to those posts if you would like.

As I said, I am very excited about this game and would love the opportunity to both play it and to perhaps help get more people both aware of and excited about a game they might not have heard a lot about!!! If you would like to speak with Josh, his email is XXXXXXXXXXXXXXXX. And to speak further about me writing up a review for The Capitals, my email is XXXXXXXXXXXXXXXX.

Thanks for your consideration!
Jim

Can anyone confirm if anything he said back in 2014 was true? Or was this just an early precursor to the later sob-story method?

I was sent the exact same message on May 6. This disgusts me.

I was heading to the post office today, but luckily a friend directed me to this thread.

Ugh, taking advantage of the goodwill of small publishers. It's just so gross...

Update:
I found this little gem in my inbox this morning, and I suspect many others did as well:

Quote:
Isaac,

Thank you again for your kindness.

As you may have heard by now, I have acted like a real ass.

I was the victim of a crime, but it did not happen last week, it happened last month. And although Forge War was among the games taken, I did lie to other publishers about other games which were not.

Hopefully you heard about my despicable behavior before sending anything out. But if you have shipped anything, please let me know how to get it back to you.

I know there is no way to fix what I did. But I am sorry.

Jim
Oh, yes, you lied about pretty much everything, but, no, wait, Forge War was still actually stolen, so I should still feel bad for you. Just ridiculous.
