I see nothing wrong with publicly discouraging people to support a company if one finds their business practices dishonorable or suspect. This is especially true if that company resorts to crowdfunding for their finances.

You want to get your game funded through Kickstarter? Then expect everyone to drag out your dirty laundry. You can't crowdfund without the crowd, and backers are miniature investors, entitled to know how and to whom their money is going.

I would expect to hear a lot more of this controversy if Brass Deluxe goes to Kickstarter.

Yes. Thats the big one. No matter what the relationship is - If he doesnt get paid, its not allowed to publish his games.
If he does gets paided it depends on the contract of course (especially, what are his rights and when does the contract expire).

These things are not only good to know for potential buyers but also for designers.

Depends on what the contract says. Royalty-free contracts aren't unheard of. There may also be one-time payments and no royalties. There may be no additional payments for derivative works like this deluxe edition. This sounds more like Wallace being unhappy with amount of payment he contracted for than Eagle trying screw Wallace.

This kickstarter should be postponed until the issue has been resolved and the facts provided to the public. Otherwise, i'm more likely to believe Wallace if EGG tries to 'hide the dirt under the carpet' and push through with the campaign.

Its very unusual in boardgames. The only cases I know where a designer gets a bulk money and no royalties is commisioned work (meaning the publisher pays him to design a specific game, usual a licensed product).

I could imagine that there are disagreements when/if the contract expired (especially because of the former/new Eagle Games). Its harder to imagine that he gave up all rights for different versions/spin offs to Eagle without remembering (For my games the publishers always have to inform me about special editions). I cant believe he forgot he did sold of his exclusive rights without royalties. And I would be quite surprised if this is the way Eagle Games payed their designers in the past (which doesnt mean thats impossible).

Lets say: Its much more common that a publisher forgots a payment (or even several in row ) than a publisher offering a bulk payment and no royalties.

Edit: Just saw that the deal about AoS was without royalties. Didnt say anything about Brass though.

My question is this. Regarding, "2009-07-20: Filed Complaint "... Wallace claims that this had no merit and therefore, it was dropped. Anyone can file a complaint. I can file a complaint saying that board games are spawned by the devil, but it means nothing unless the court rules in favor of me. Since it has been 6 years since 2009, the fact that there is no followup to this complaints lends credence to what Wallace has to say... It does not support FRED like they apparently think it does.

I think the fact that FRED put up a court claim from 2009, with no followup, support Wallace's story of the case having no merit. If they had followup court documents, they would DEFINITELY have posted them if they supported their claims.

Except FRED is the one going to infringe, not Martin.

They have the burden of proof.

So, where is that contract? FRED claims it has the rights. Seems like that they need to prove that.

Let's not divert the argument.

FRED claims it has rights to reprint Brass, Martin indicates those rights were revoked per his request in late 2013.

Since FRED is going to be the infringing party here and is claiming rights, they need to prove it.

All the other garbage is just noise and distractions.
